1.2) Students who enroll in a course have lifetime access to the course materials.

1.4) These Terms and Conditions shall be governed by and construed in accordance with the laws of Iowa and the United States of America.
1.5) If you do not agree with these Terms and Conditions you must cease the course immediately and notify Apprenticeship America , INC (“Apprenticeship America ”) of your intent not to continue.
2) Your Apprenticeship America Account
2.1) A registered account (“Account”) is the area in our Website, which is accessible via a password and contains personal information regarding the user.
2.2) You are responsible for maintaining the security of your Account and fully responsible for all activities that occur under the account and any other actions taken in connection with the Account.
2.3) You must immediately notify Apprenticeship America , INC (“Apprenticeship America ”) of any unauthorized uses of your Account or any other breaches of security.
2.4) Apprenticeship America , INC (“Apprenticeship America ”) will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.
2.5 Registration of a user requires the user to provide a valid email address for the communication between eLearning Industry and the user along with a valid name, amongst other information required pursuant to Section 6.4.a below.
3) Cancellation Policy
3.1) If a student cannot access the course online via Apprenticeship America .App because they fail to meet the required system requirements given on the website.
4) e-Learning Materials
4.1) The training material is property of Apprenticeship America , INC (“Apprenticeship America”)
4.2) This training material has been prepared, maintained, updated, and distributed by Apprenticeship America , INC (“Apprenticeship America ”)
4.3) The use of the training material on our courses is restricted to the Registered User who has been supplied with the log-in details by a registered partner of Apprenticeship America Inc. as part of an authorized course.
4.4) The Registered User shall not copy, share, modify, transmit, distribute, or in any way, exploit the copyrighted materials provided by Apprenticeship America , INC (“Apprenticeship America ”) other than for their own individual training. Use for any other purpose is expressly prohibited by law and any violators will be prosecuted.
4.5) The Registered User shall not permit anyone else to copy, use, modify, transmit, distribute, or in any way, exploit the copyrighted materials.
4.6) The materials made available by Apprenticeship America , INC (“Apprenticeship America ”) are provided “as-is” without warranties of any kind, either expressed, or implied, including, but not limited to, all implied warranties of merchantability, fitness for a particular purpose, title or non-infringement.
4.7) Apprenticeship America , INC (“Apprenticeship America ”) does not warrant that the materials will be error-free including technical inaccuracies, nor free of viruses, or other harmful matter. The entire cost of any necessary service, repair, or correction, is the Registered User’s responsibility.
4.8) Apprenticeship America , INC (“Apprenticeship America ”) may make improvements, or changes, to this material at any time without prior notification.
4.9) All other trademarks, service marks, and trade names in this material are the marks of the respective owners and any unauthorized use is prohibited.
4.10) All rights not expressly granted herein are reserved.
4.11) These Terms and Conditions shall be governed by and construed in accordance with the laws of Iowa and the United States of America.
4.12) If you do not agree with these Terms and Conditions you must cease to use the e-learning immediately.
5) Access to the courses
5.1) Apprenticeship America , INC (“Apprenticeship America ”) strives to provide the course content to its Students on a continuous basis. To that end, Apprenticeship America , INC (“Apprenticeship America ”) will take all commercially reasonable efforts to provide uninterrupted Access of the courses to its students. However, from time to time, students may be unable to Access the courses due to conditions beyond Apprenticeship America , INC (“Apprenticeship America ”) control. Such conditions include, but are not limited to force majeure, acts of God, power outages, and the acts of computer hackers and others acting outside the law. Also, from time to time, access may be unavailable due to software issues, server downtime, increased internet traffic or downtime, programming errors, regular maintenance of the system, and other related reasons. In response to any unavailability of the courses to its Students, Apprenticeship America , INC (“Apprenticeship America ”) will take all commercially reasonable steps to ensure access is restored within a reasonable period of time. The term “commercially reasonable,” as used in these Terms, shall mean reasonable efforts taken in good faith without an unduly or burdensome use or expenditure of time, resources, personnel, or money.
5.2) Apprenticeship America , INC (“Apprenticeship America ”) endeavors to provide the highest quality content to its Students. To that end, Apprenticeship America , INC (“Apprenticeship America ”) reserves the right, in its sole discretion, to change, modify, or discontinue any aspect or feature of this Site in whole or in part, including, without limitation, the content, availability, Access and/or the Terms of this Site. Such changes, modifications, additions or deletions will be effective immediately upon notice thereof, which notice may be made by posting such changes on this Site.
5.3) Users are solely responsible for ensuring that they have sufficient and compatible hardware, software, telecommunications equipment, and Internet service necessary for use of the Site.
6. Registration/Sign-Up
6.1) Content published on Apprenticeship America , INC (“Apprenticeship America ”) is accessible by all visitors. However, certain features and services may require registration. Users may register (“Create New Account”) on-site (for example, at https://Apprenticehshipamerica.com/sign-up/. Upon signing-up, an Account is created for the user. Users who sign-up on-site are required to confirm their registration by clicking on an activation link sent to them via email. All active user accounts have the capability to view course materials.
Users are required to provide part or all of the following information below:

5. Apprenticeship America , INC (“Apprenticeship America ”) reserves the right to reject any registration request at its sole discretion.
7.) Communication and Account Notifications
7.1. Users can expect to get notifications about their account via text message for test scores, new job availability and one on one communications to setup check in meetings. Only registered users in an apprenticeship progrma will receive notifications about their account via text messages.
7.2. You can cancel the SMS service at any time. Just text “STOP” to the short code. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
7.3. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at [email protected]
7.4. Carriers are not liable for delayed or undelivered messages
7.5. As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive no more than 1-4 automated text messages per week. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

9.5) In no event will warranties provided by law, if any, apply unless they are required to apply by statute notwithstanding their exclusion by contract.
8.6) This disclaimer is applicable to any damage or injury resulting from the negligence or an omission of Apprenticeship America , INC (“Apprenticeship America ”), computer virus or other similar item, telecommunications errors, or unauthorized access to or use of user information through theft or any other means. 10) Confidentiality / Non-disclosure

11.1) You agree to indemnify and hold harmless Apprenticeship America, INC (“Apprenticeship America ”), its contractors, and its licensors, and their respective directors, officers, employees, and agents from and against any and all claims and expenses including attorneys’ fees, arising out of your use of the Website, including but not limited to your violation of the TOS.
12) Arbitration
12.1) Any dispute arising under this Agreement shall be resolved by arbitration by a single Arbitrator in Ankeny, Iowa, USA in accordance with the then-current rules of the American Arbitration Association.
12.2) In the event that any party fails to submit any dispute arising from this agreement to mediation first, or fails to meaningfully participate in mediation, that party will not be entitled to attorney’s fees as provided in this paragraph.
12.3) Any judgment upon the award entered by the arbitrator may be entered in any court having jurisdiction.
12.4) Costs of arbitration, including reasonable attorney’s fees incurred in arbitration as determined by the Arbitrator, together with any reasonable attorney’s fees incurred by prevailing party in Court enforcement of the arbitration award after it is rendered by the Arbitrator, shall be paid to the prevailing party by the party designated by the Arbitrator or Court.
